In accordance with the "Regulations on The Administration of Construction Enterprise Qualification" (Decree No. 22 of the Ministry of Housing and Urban-Rural Development) and the "Standards for Construction Enterprise Qualification" (No. 159 [2014] of The Ministry of Housing and Urban-Rural Development), the Ministry of Housing and Urban-rural Development has formulated the "Opinions on the Implementation of The Regulations and Standards for The Administration of Construction Enterprise Qualification", which is hereby printed and distributed to you for your compliance.        Regulations on the Administration of Construction Enterprises' Qualifications and Opinions on the Implementation of Qualification standards

 

 

In order to standardize the management of the qualification of construction enterprises, this Implementation Opinion is formulated in accordance with the Provisions on the Management of The Qualification of Construction Enterprises (Decree No. 22 of the Ministry of Housing and Urban-Rural Development, hereinafter referred to as the Provisions), the Standards for the Qualification of Construction Enterprises (CCB [2014] No. 159, hereinafter referred to as the Standards) and relevant laws and regulations.

I. Qualification application and licensing procedures

(1) Those who apply for the qualification of construction enterprises shall obtain the company legal person Business License issued by the administrative department for industry and commerce according to law.

(2) An enterprise applying for the qualification of a construction enterprise approved by the Ministry of Housing and Urban-Rural Development shall file an application in accordance with the application procedures prescribed in Article 12 of the Provisions. Military-owned enterprises may apply to the Ministry of Housing and Urban-Rural Development by the Engineering Administration Bureau of the Ministry of General Administration of Infrastructure and Housing.

(3) An enterprise applying for the qualification of a construction enterprise approved by the competent department of housing urban and rural construction under the people's government of the province, autonomous region or municipality directly under the Central Government (hereinafter referred to as the competent department of housing urban and rural construction at the provincial level) shall submit an application in accordance with the procedures prescribed by the competent department of housing urban and rural construction at the provincial level. The provincial competent housing and urban-rural construction departments shall publish relevant examination and approval procedures on their portals.

(4) An enterprise applying for the qualification of a construction enterprise approved by the competent department of housing and urban construction under the people's government of a city divided into districts shall submit an application in accordance with the procedures prescribed by the competent department of housing and urban construction under the people's government of a city divided into districts. The competent housing and urban-rural construction departments of the people's governments of cities divided into districts shall publish relevant examination and approval procedures on their portal websites.

(5) If an enterprise applies for the qualification of a construction enterprise for the first time or for an additional item, its qualification shall be assessed according to the lowest level of qualification.

Enterprises may apply for various qualifications in the three series of general construction contracting, specialized contracting and construction labor service qualifications, and the number of such qualifications shall not be restricted.

(6) If an enterprise applies for an upgrade of qualification (including an upgrade to a higher level) or an addition of qualification, the qualification licensing authority shall check whether there are any illegal or illegal ACTS listed in Article 23 of the Provisions between one year before the application date and before the decision on qualification licensing is made, and take the verification results as the basis for qualification licensing.

(7) There is no time limit for enterprises to apply for qualification upgrading.

(8) The qualification licensing authority shall publish the results of enterprise qualification licensing on its portal website.

(9) The qualification licensing authority shall keep all written materials such as application and examination for construction enterprises for at least 5 years.

(ten) "standard" contain special engineering contracting qualification of correction and translation, building structure reinforcement, special lifting equipment, special lightning protection engineering such as content, can by provincial housing department in charge of urban and rural construction according to the enterprise has professional and technical personnel and technical director individual performance, approval of the corresponding qualifications.

Provincial housing department in charge of urban and rural construction according to the region's special situation, need to increase the special engineering contracting qualification standards, can refer to the conditions of the "special engineering contracting qualification standard", submitted to the housing in urban and rural areas approved by the ministry of construction, by applying the provincial housing shall be promulgated by the competent department of urban and rural construction, and the limit in the implementation of the provincial administrative area.

Enterprises that have obtained comprehensive engineering design qualification and class A industrial qualification but have not obtained the qualification of construction enterprise may directly apply for the first-level general contracting qualification of corresponding categories of construction projects, and the general contracting achievements of corresponding scale completed by the enterprises may be declared as their project performance. The comparison table between engineering design qualification and construction general contracting qualification is shown in Annex 4-1.

Other engineering design enterprises shall apply for construction enterprise qualification in accordance with the requirements of the first application.

(11) is responsible for the licensing of housing urban and rural development of construction enterprise qualifications of intermediate and above titles (relating to the highway, water transportation, water conservancy, communications, railways, civil aviation, etc, except qualification), on-site management personnel and skilled workers, enterprise assets audit, by the enterprise of industry and commerce registered provincial departments in charge of urban and rural construction of housing, in which the state-owned assets supervision and administration department under the State Council directly regulate construction enterprises (hereinafter referred to as the "central construction enterprises") declare directly, by the central building enterprise audit; The provincial housing and urban-rural construction departments and the central construction enterprises shall report the audit results together with the enterprise application materials, and the Ministry of Housing and Urban-Rural Development shall publish the audit results together with the enterprise basic information on the Ministry of Housing and Urban-Rural Development website, and organize spot checks.

Ii. Requirements for application materials

(13) enterprise for the first time to apply for qualification, application upgrade, increase of qualifications, continuation, a simple change, lost fill do certificate, as well as the merger, division, restructuring, reorganization, change across the province and other particulars, apply for qualifications after respectively according to the following relevant requirements and qualification for construction enterprises to declare material list (annex 2) requirements, submit relevant materials:

1. Enterprises without qualifications of construction enterprises and applying for qualifications of construction enterprises shall submit materials in accordance with the requirements of the first application.

2. If an enterprise with the qualification of construction enterprise applies for the qualification of grade One or higher in the same category, or an enterprise with the comprehensive qualification of engineering design or the qualification of Industry Class A directly applies for the qualification of Grade One general construction contracting, it shall submit materials in accordance with the requirements for upgrading.

3. If an enterprise that already has the qualification of a construction enterprise applies for adding another type of construction enterprise qualification, it shall submit materials in accordance with the requirements for adding the item.

4. If the enterprise whose qualification certificate has expired applies for renewing the validity of the certificate, it shall submit the materials according to the extension requirements.

5. The enterprise merger, division, restructuring, reorganization and change across the province, from domestic to foreign investment enterprises property or by foreign investment into domestic capital, according to the housing urban and rural development of construction enterprise restructuring, merger, division, and so on and so forth qualification verification issues related to notice (built city [2014] no. 79) listed in the submitted materials.

6. If an enterprise needs to change the content of the qualification certificate due to changes in its name, registered capital, legal representative or registered address (within the provincial region), it shall submit the materials according to the simple change requirements.

7. If an enterprise loses its qualification certificate, it shall apply for a new qualification certificate and submit materials as required.

(14) The enterprise shall submit the Application Form for Construction Enterprise Qualification (Annex 1-1) in duplicate with one set of annex materials. If professional qualifications are involved in roads, water transport, water conservancy, communications, railways, civil aviation, etc., one application form for Construction Enterprise Qualification and one set of annex materials shall be added for each professional qualification.

(15) The qualification accepting authority shall be responsible for checking the original materials provided by the enterprise and returning them to the enterprise after checking. The application materials shall not be modified or replaced after being accepted by the qualification accepting authority.

(16) If the qualification licensing authority doubts the application materials of the enterprise, the enterprise shall provide the original and certification materials of the relevant materials, and cooperate with the relevant departments to carry out on-the-spot verification when necessary.

(17) The attached materials shall be bound in the order of "comprehensive data, personnel data and project performance data", with A4(210mm×297mm) type paper, and the general catalog and declaration instructions with page Numbers shall be marked. The soft cover shall be adopted and the page Numbers shall be compiled page by page.

(18) The application materials of the enterprise must be in Chinese. The original text of the materials in other languages must be accompanied by an accurate Chinese translation. The application materials must have complete data, standard form filling, complete seal and clear handwriting, and the attached materials must be clear and legible.

(19) Specific requirements for applying for qualification electronically will be formulated separately.

Iii. Qualification Certificate

(20) The construction enterprise qualification certificates shall be divided into originals and duplicates and shall be uniformly printed by the Ministry of Housing and Urban-Rural Development. The original specification of the new construction enterprise Qualification Certificate is 297mm×420mm (A3); The size of the copy is 210mm×297mm(A4). The qr code is added to the qualification certificate, and the public can check the qualification of the enterprise through the QR code. The qualification certificate shall be uniformly coded nationwide and automatically generated by the qualification certificate management system. The new version of the qualification certificate coding rules for construction enterprises is shown in Annex 5.

(21) Each set of construction enterprise qualification certificates shall consist of 1 original and 1 copy. The qualifications approved by the same qualification licensing authority are printed on a set of qualification certificates; After making the licensing decision, different qualification licensing authorities shall print the qualification certificates respectively. No qualification licensing authorities at any level may increase the number of copies of certificates.

(22) In case of any change in its name, registered capital, legal representative or registered address (within the provincial level), the enterprise shall apply to the qualification licensing authority for such change.

(23) If an enterprise loses its qualification certificate, it shall apply to the qualification licensing authority for a replacement.

(24) If an enterprise needs to renew or return its qualification certificate due to alteration, upgrade, cancellation or other reasons, it shall hand the qualification certificate to the original qualification licensing authority to take it back and destroy it.

(25) The construction enterprise qualification certificate shall be valid for 5 years. The term of validity of the certificate refers to the period from the date when the enterprise obtains the qualification of the first construction enterprise of this set of certificates. The term of validity of the certificate shall remain unchanged except for renewal and re-verification by the enterprise. In case of re-verification of qualification, the validity period shall be re-calculated from the date of verification (except for those handled according to simplified examination and approval procedures).

(26) Extension of qualification certificates

1. The enterprise shall apply for the extension of the validity period of the qualification certificate in accordance with the original way of qualification declaration 3 months before the expiration of the validity period of the qualification certificate. If the net assets and main personnel of an enterprise meet the requirements of the existing qualification standards, the qualification certificate with a validity period of 5 years shall be replaced upon approval by the qualification licensing authority, and the validity period shall be counted from the date of approval and renewal.

2. If an enterprise applies for the renewal of qualification within 3 months before the expiration of the qualification certificate, the qualification accepting department shall accept the application; The enterprise shall not undertake any project within the scope of the qualification within the period of solstice's approval for extension upon expiration of the qualification certificate.

3. If an enterprise no longer meets the requirements of the qualification standards, the qualification licensing authority shall not approve the extension of its corresponding qualification. The enterprise may apply for re-approval of the same type of qualification lower than the original qualification level within 3 months after the announcement of the qualification licensing results. If you have not applied for more than 3 months, apply from the lowest level of qualification.

4. If the qualification certificate expires and the enterprise still does not apply for renewal, the qualification certificate will automatically become invalid. If it is necessary to continue construction activities, the enterprise shall reapply for the lowest level of qualification.

Iv. Supervision and management

27. The competent housing and urban construction departments at all levels and other relevant departments shall establish credit files for construction enterprises engaged in construction activities, formulate dynamic supervision measures, implement differentiated management according to the credit conditions of the enterprises, and actively use information means to supervise and administer the construction enterprises.

The competent housing and urban and rural construction departments and other relevant departments of the people's governments at or above the county level shall, after the enterprise has acquired the qualification of a construction enterprise, regularly or irregularly check whether the assets and main personnel meet the standard conditions for qualification and the market behavior of the enterprise.

(28) Where an enterprise applies for an upgrade of qualification (including a first-class upgrade) or an addition of qualification, the qualification licensing authority shall check whether all the assets and main personnel required by the qualification of the existing construction enterprise meet the requirements of the standards.

(29) The enterprise shall accept the supervision and administration of the qualification licensing authority, the competent housing and urban and rural construction departments and other relevant departments where the enterprise is registered and where the project is to be undertaken.

(30) for violation behavior of enterprises, illegal behavior happen DeXianJi above housing shall be investigated according to law by the competent department of urban and rural construction, will be treated as illegal facts and the results of punishment or advice told the qualification licensing organ, and step by step to housing and urban-rural development, at the same time, charge the penalty to construction enterprise credit files, in the national construction market regulation and credit platform. If the industrial and commercial registration of an enterprise is not in this province, the competent department of housing urban and rural construction at or above the county level where the illegal act occurs shall, through the competent department of housing urban and rural construction at the provincial level, inform the qualification licensing organ of the enterprise.

(31) for housing urban-rural development license qualification of construction enterprise, needs to be closed, to reduce the level of qualification, administrative punishment shall be revoked the certificate of qualification and so on, the local people's government at the provincial level and below housing department in charge of urban and rural construction and other relevant departments, within 30 working days after verify that the illegal facts, should through the housing department in charge of urban and rural construction at the provincial level or the relevant departments of the State Council, will be treated as illegal facts, suggest to submit the housing urban and rural development; The Ministry of Housing and Urban-Rural Development shall impose corresponding administrative penalties according to law.

(32) Departments in charge of housing urban and rural construction at all levels shall promptly publicize the relevant punishment information and report it to the competent departments of housing urban and rural construction at the next higher level for the record.

  

V. Relevant explanations and indicators

According to the nature of the project, the demolition work shall be undertaken by enterprises with corresponding qualifications.

(34) to the original standard into the corresponding construction general contracting qualification of tall buildings, telecommunications, foundation treatment, embankment, hydraulic structures, hydraulic tunnel, hydraulic dam thermal power equipment installation and smelting furnaces, mechanical and electrical equipment installation, chemical oil pipeline installation, pipeline, urban rail transit engineering 12 professional contracting qualification, in the process of the corresponding project contracting, can according to the engineering properties and size of the corresponding categories and levels of construction general contracting qualification of the enterprise. Among them, the urban rail transit project shall be undertaken by the enterprise with super grade or grade A qualification of general contracting of municipal public works construction; The station construction in the urban rail transit project shall be undertaken by the enterprise with super grade or grade I qualification as the general contractor of the construction project.

(35) Qualifications related to roads, water transportation, water conservancy, communications, railways, civil aviation and other fields, as well as professional qualifications are as follows:

1. Qualifications related to highways: general contracting qualification for highway construction, professional contracting qualification for highway pavement engineering, professional contracting qualification for highway subgrade engineering, and professional contracting qualification for highway traffic engineering.

2. Qualifications related to water transportation: general contracting qualification for port and waterway engineering construction, specialized contracting qualification for port and coastal engineering, specialized contracting qualification for waterway engineering, specialized contracting qualification for navigation building engineering, specialized contracting qualification for port and waterway equipment installation and water delivery engineering.

3. Qualifications related to water conservancy: general contracting qualification for water conservancy and hydropower project construction, professional contracting qualification for hydraulic metal structure making and installation project, professional contracting qualification for river and lake renovation project, professional contracting qualification for water conservancy, hydropower and electromechanical installation project.

4. Qualifications related to communication: general contracting qualification for communication engineering construction.

5. Qualifications related to railways: general contracting qualification for railway engineering construction, professional contracting qualification for railway electrical engineering, professional contracting qualification for railway laying rails and girders, and professional contracting qualification for railway electrification engineering.

6. Qualifications related to civil aviation: professional contracting qualification for airport airport road engineering, civil aviation air traffic control engineering and weak current system engineering of airport, and professional contracting qualification for airport visual AIDS.

7. It involves several professional qualifications: bridge engineering contracting qualification, tunnel engineering contracting qualification, nuclear engineering contracting qualification, offshore petroleum engineering contracting qualification, power transmission and transformation engineering contracting qualification, steel structure engineering contracting qualification.

(36) Central construction enterprises refer to those enterprises directly supervised by the state-owned assets management department of the State Council, whose main business is construction industry or subordinate first-level enterprises with a large number of construction enterprises. See Annex 4-2 for the specific list.

The first-tier enterprises subordinate to the central construction enterprises refer to the construction enterprises wholly owned or absolutely controlled by the central construction enterprises.

(37) Enterprise assets

1. The net assets of an enterprise shall be assessed according to the net assets index in the audited financial statements of the year before the application for qualification or the current period. If the applicant applies for qualification for the first time, the registered capital in the business License of the enterprise shall prevail. If the applicant applies for multiple qualifications, the net assets of the enterprise shall not be assessed cumulatively, and shall be assessed according to the highest value of the net assets index required by the applied qualification and the qualification standard.

2. The plant includes the plant owned or leased by the enterprise.

(38) Key personnel of the enterprise

1. The main personnel of the enterprise include: registered practitioners, technical title personnel (including the person in charge of technology), on-site management personnel, technical workers and other four categories of personnel.

2. The intermediate and above technical titles mentioned in the "Standards" refer to the professional technical titles of engineering series reviewed by the personnel competent departments at or above the city level divided into districts or authorized units thereof.

3. The site management refers to an enterprise that with more than one year labor contract in accordance with the law, in accordance with the law, pay social insurance for its by the enterprise, and according to the provisions of provincial housing department in charge of urban and rural construction and corresponding post certificates issued by the relevant departments of the people, housing and urban-rural development or the relevant departments of the State Council approved the corresponding post certificates issued by the industry association.

Relevant post certificates include: post training qualification certificate, safety production qualification certificate, professional qualification certificate, etc.

4. Technical workers, it refers to enterprise more than one year labor contract in accordance with the law, in accordance with the law, pay social insurance for its by the enterprise, and obtain housing urban and rural construction, the relevant departments of the State Council, the provincial housing or relevant departments approved by the competent department of urban and rural construction vocational training certificate issued by the institutions or construction enterprises or certificates of professional skill level.

Where an enterprise applies for construction general contracting qualification with its wholly-owned or majority-owned labor enterprise technical workers as its main personnel, the social insurance for skilled workers shall be paid by its wholly-owned or majority-owned labor enterprise.

5. The main personnel of the enterprise shall meet the requirements of 60 years of age or below and the enterprise shall pay social insurance for them.

6. If the main personnel of the enterprise are employed or registered in two or more enterprises, it shall not be regarded as the effective personnel assessment required by the qualification standards.

7. The qualifications, professional titles, performance and other aspects of the technical person in charge shall be assessed according to the relevant standards and requirements of the qualification applied for by the enterprise. The enterprise shall have one professional and technical person in charge according to the type of qualification applied for.

8. The "relevant major" of intermediate and above professional title personnel shall be assessed according to their professional title or the major they have learned in their graduation certificate.

Among them, the major of structure includes: civil engineering, industrial and civil construction, structure, building construction, building engineering and so on.

9. When an enterprise applies for a qualification of a certain category, the number, specialty and type of work of each category of its main personnel shall meet the requirements of the Standard. If a person holds two or more certificates of registration, technical title, post certificate, technical worker training certificate or vocational skill level certificate at the same time, he can only be assessed as one person; However, if a person has both a registration certificate and a technical title, he may be assessed as both a registered person and a technical title.

10. The enterprise applies for multiple categories of qualifications. The number, specialty and type of work of each category of the main personnel of the enterprise shall meet the requirements of the Standard respectively, and the number of personnel of each category shall not be assessed cumulatively. For example, an enterprise applies for the first-level qualification of general contracting of construction projects and municipal public works at the same time. As long as the enterprise has 150 intermediate and above skilled workers, it can meet the requirements of two categories of skilled workers respectively.

If a person has two or more technical titles (registration qualifications) or professional jobs, they may be assessed separately. For example, if a person has both the professional title certificate of construction engineering and the diploma certificate of road engineering, he can be assessed as the professional title personnel required by the enterprise to apply for the general contracting qualification of construction engineering and municipal public works respectively.

11. Social insurance certificate refers to the statement of basic endowment insurance issued by the social pooling insurance fund management department or the payment details of the unit stamped with the official seal of the social pooling insurance fund management department, as well as the payment voucher of the enterprise (social insurance payment invoice or bank transfer voucher); Social insurance proof should reflect the following content at least: pay insurance unit name, personnel name, social security number (or id number), insurance, pay fee period, etc. Social insurance card is clear in pay cost unit should be consistent with declare unit, other unit pay such as orgnaization of service of superior company, subsidiary, institution, human resources or individual pay social insurance all do not affirm, the social insurance of branch pay can give affirm.

12. It is required in the Standard that there shall be not less than ××× professional registered builders in total, and it is not required that the listed majors must be complete.

13. If the "Standard" defines the professional titles of professional staff and requires complete professional titles, it means that the applicants shall be composed of technical staff with corresponding professional titles, and there shall be at least one person in each major. Such as: building engineering construction general contracting level qualification requirements in the "construction engineering related not less than 30 people, intermediate above title personnel and complete structure, water supply and drainage, hvac, electrical and other professional", refers to 30 people shall be composed of structure, water supply and drainage, hvac, electrical and other four intermediate above title personnel composition, structure, water supply and drainage, hvac, electrical and at least one person in every major, other professionals will not be approved.

14. The "Standards" does not define the professional titles of personnel with technical titles, but requires some professional titles to be complete, means that there is at least one professional with complete requirements, while the rest of the applicants do not define the professional titles. Such as: waterproof anti-corrosion insulation engineering contracting qualification requirements in "engineering intermediate above title sequence and total registered construction engineer not less than 15 people, and the structure, material or chemical and other professional complete", is a sequence of intermediate or above technical titles or the number of the sum of the number of registered construction engineer or both for 15 people, but should be at least 1 professional structure, 1 material or chemical professionals, other personnel professional does not make the request.

15. In the Standards, professional titles of technical personnel are limited and complete professions are not required, which means that the number of applicants in the corresponding profession can meet the standard requirements. The number of professionals in each category is not required. For example, in the first grade qualification standard for general contracting of water conservancy and hydropower projects, it is required that "no less than 60 people should have intermediate or above professional titles in water conservancy and hydropower projects", which means that the total number of professionals in water conservancy and hydropower projects can meet 60. There is no limit on the number of people in each major, and all majors are not required to be complete.

16. In the "Standard", the position certificates of on-site management personnel are complete, which means that there is at least one person with post certificates required in the enterprise declaration personnel, and the number of other post certificates is not required. Such as: the airport ChangDao professional contracting qualification standard requirements "hold post certificate of construction site management personnel shall not be less than 30 people, and the builder, quality engineer and complete safety personnel, materials and documenter personnel", refers to the construction site management positions held by at least 30 people have the builder, quality engineer, safety personnel, materials, operate each 1 person, the rest of the staff can be the builder, quality engineer, safety personnel, materials, resposible, service engineer, cost engineer and surveyor, the operator, standard engineer, mechanical engineer etc. Any kind of personnel.

17. Where there is no requirement in the Standards for the type of work of skilled workers, the type of work of skilled workers shall not be assessed.

18. Performance under the supervision of the Technical Leader (or registered builder) in the Standards refers to the project completed under the supervision of the construction project manager or the technical leader of the project. (1) More than 200 kilometers of road subgrade above grade iii shall be built accumulatively..." When an enterprise applies for grade III qualification of general contracting for highway construction, the individual performance under the supervision of the technical person-in-charge (or registered constructor) shall be the subgrade project of a highway above grade III, and the length shall not be assessed.

(39) Technical equipment

The equipment clearly required in the "Standard" shall be the equipment owned by the enterprise, and the equipment purchase invoice of the enterprise shall prevail for assessment. Among them, those who apply for the general contracting qualification of port and waterway construction shall provide the certificates of main performance indexes, ownership and inspection qualification of the equipment.

(40) Project performance and contract scope of the enterprise

1. If the project performance of a unit meets multiple technical indicators at the same time, it shall be assessed as one indicator only. In the case of accumulative and single technical indicators assessed respectively in the Standards, the performance of the same project may be assessed at the same time, except for railway qualifications.

2. The "× classes of × classes" required in performance must be met separately and cannot be substituted for each other. For example, the first-grade qualification standards for construction projects require enterprises to complete "more than two of the four types of projects", which means that in the projects completed by enterprises, the assessment indicators of height, number of floors, single area and span should meet at least two types, otherwise, the performance will not reach the standard.

3. If an enterprise applies for more than one type of qualification, its project performance shall meet the standard conditions for qualification of each type respectively.

4. Those who apply for the qualification of general contracting for construction projects can only be regarded as the performance assessment of general contracting after the completion and acceptance of the project by the unit.

5. Any project undertaken by an enterprise by way of general construction contract, whether or not the project is subcontracted, can be regarded as the performance assessment of its general construction contract.

6. For the application for professional contracting qualification, the performance assessment of professional projects undertaken separately by the enterprise according to law shall be carried out.

7. The scope of the general construction contract project includes the main project and supporting projects. Supporting projects shall not be applied for the project performance assessment of general contracting qualification as an enterprise alone.

8. The term "recent 5 years" or "recent 10 years" as required in the Standard refers to the performance of the project completed within 5 or 10 years from the year of application for qualification. For example, the reporting year is 2015, and the performance in the "recent five years" refers to the projects completed (delivered) after January 1, 2010 and qualified for acceptance. The project performance that exceeds the time limit will not be recognized.

9. Representative project achievements beyond the scope of contracted projects with the enterprise's qualification shall not be recognized. If an enterprise takes overseas contracted projects as its representative project performance declaration, it shall not assess whether it has exceeded the scope of contracted projects with qualification.

10. The project performance declared by the enterprise shall not be recognized if the project leader is not the registered constructor of the enterprise, does not have the qualification of registered constructor, works beyond the scope of practice of registered constructor, or ACTS as the project leader of two or more projects in violation of relevant provisions.

11. Confidential projects shall not be reported as project performance on behalf of the enterprise.

12. "Amount of a single contract" means the contract price contained in a single contract.

13. The height of the building works shall be calculated from elevation plus or minus zero to the eaves.

14. The number of floors of construction projects refers to the number of floors between positive and negative zero and cornice. Among them, the equipment floor is not counted.

15. Group buildings (regardless of whether the foundation is connected or not) are not used as performance assessment of single building area.

16. The span performance of light steel and grid structure is not regarded as the performance assessment of the general contracting span of construction projects.

17. If an enterprise is demoted or revoked of qualification due to its responsibility for engineering quality or production safety accidents, or is criticized or revoked of qualification due to falsification of its engineering performance, its corresponding engineering performance shall not be declared as representative engineering performance.

Vi. Transition Period

(41) solstice as of December 31, 2016 as implemented in the provisions is the transitional period.

(42) Enterprises that have obtained construction enterprise qualification according to the original standards shall, before December 31, 2016, renew the new version of construction enterprise Qualification certificate (hereinafter referred to as "Renewal") in accordance with the requirements of the Provisions, the Standards and the Implementation Opinions. If the assets, main personnel and technical equipment of the enterprise meet the requirements of the "Standards", the qualification licensing authority shall issue a new version of the construction enterprise qualification certificate, which shall be valid for 5 years. As of January 1, 2017, the old version of the construction enterprise qualification certificate will automatically become invalid.

If the assets, main personnel and technical equipment of the enterprise do not meet the requirements of the "Standards", the qualification licensing authority shall not approve the replacement of corresponding qualifications. The enterprise may, within 3 months after the announcement of the replacement result, propose the replacement of the same category of qualifications that are lower than the original qualification level. If you have not applied for more than 3 months, apply from the lowest level of qualification.

Enterprises shall apply for the replacement of all construction enterprise qualifications in one time according to the licensing procedures of the Provisions, and submit the corresponding materials according to the requirements for the replacement of construction Enterprise Qualifications in the List of Application Materials for Construction Enterprise Qualifications.

Enterprises can only choose 5 categories of professional contracting qualifications at most, more than 5 categories of other professional contracting qualifications according to the requirements of the additional qualification.

(43) If an enterprise that has obtained the qualification of a construction enterprise according to the original standards applies for the upgrading of the qualification (including the upgrading of the first grade) or the addition of the qualification, all existing construction enterprises shall apply for the replacement of the qualification certificate at the same time according to the provisions of Article 42.

(44) Enterprises that have obtained construction enterprise qualifications according to the original standards may, in principle, apply for renewal of qualifications of the same category and level in the Standards, wherein:

1. Enterprises that have obtained the professional contracting qualification of ready-mixed commercial concrete, garden and ancient architecture, electromechanical equipment installation, airport air control engineering and weak current system of terminal building, attached lifting scaffold, power transmission and transformation engineering according to the original standard can apply for the corresponding professional contracting qualification after the name change in the Standard.

2. Enterprises that have obtained professional contracting qualifications according to the original standards for building waterproofing, anti-corrosion and thermal insulation, intelligent building, electronics, installation of port loading and unloading equipment, navigation equipment installation, water traffic control works, etc., may apply for the professional contracting qualifications after the merger in the Standards for renewal.

3. According to the original standard in tall buildings, telecommunications engineering, foundation treatment, embankment, hydraulic structures, hydraulic tunnel, hydraulic dam thermal power equipment installation and smelting furnaces, mechanical and electrical equipment installation, chemical oil pipeline installation, pipeline engineering and other professional contracting qualification of the enterprise, may apply for the "standard" in item 1 is lower than the original level of qualification into the corresponding class for renewal of the construction general contracting qualification; Among them, enterprises that have obtained the professional contracting qualification for embankment projects according to the original standard may also apply for the professional contracting qualification for river and lake renovation projects of no higher level than the original qualification level.

4. Enterprises that have obtained the professional contracting qualification of CRC engineering according to the original standard may apply for the general contracting qualification of municipal public engineering construction at level I or below.

5. Enterprises that have obtained the level-3 professional contracting qualification according to the original standard, such as building waterproof, anticorrosive and thermal insulation, intelligent building, electronic building, and building decoration and decoration engineering, can apply for the corresponding level-2 professional contracting qualification in the "Standard"; Enterprises that have obtained grade II professional contracting qualification for building waterproof projects according to the original standards may apply for the certificate of grade I professional contracting qualification for waterproof, anticorrosion and heat preservation projects.

6. Enterprises that have obtained the professional contracting qualification of highway traffic engineering and water traffic control engineering without grade according to the original standard may apply for the corresponding first-class professional contracting qualification in the "Standard".

7. Enterprises that have obtained the qualification of formwork subcontracting and scaffolding subcontracting according to the original standards may apply for the professional contracting qualification of formwork and scaffolding in the "Standards".

(45) During the transition period, enterprises that have obtained construction enterprise qualification according to the original standards shall, in principle, undertake projects in accordance with the contracted project scope of the qualification category and grade corresponding to the Standards, among which:

1. Enterprises that have obtained the merged professional contracting qualification according to the original standard shall undertake projects within the scope of the merged professional contracting qualification in the Standard.

2. Enterprises with professional contracting qualifications that have been incorporated into corresponding general contracting qualifications according to the original standards may still undertake projects within the scope permitted by their professional contracting qualifications.

3. Those who have obtained the professional contracting qualification for blasting and demolition projects according to the original standards may still undertake corresponding projects within the scope permitted by their professional contracting qualifications.

4. Enterprises that have obtained level-II and LEVEL-III professional contracting qualifications for building waterproof projects according to the original standards shall undertake projects within the scope of level-I and LEVEL-II professional contracting qualifications for waterproof, anticorrosion and insulation projects in the "Standards" respectively.

5. Enterprises that have obtained labor subcontracting qualifications according to the original standards shall undertake labor operations within the contracting scope of construction labor qualifications in the Standards and shall no longer be divided into categories and grades. Enterprises that have obtained the qualification of subcontracting formwork and scaffolding work according to the original standard can only sign labor subcontracting contracts when undertaking business.

(46) When exercising dynamic supervision over the qualifications of construction enterprises, the competent housing and urban-rural construction departments and other relevant competent departments shall exercise dynamic supervision over those enterprises that have obtained the qualifications of construction enterprises according to the original standards in accordance with the Provisions and the original standards; Dynamic supervision shall be carried out in accordance with the Provisions and the Standards for enterprises that have obtained the qualification of construction enterprises.

Seven, other

(48) When an enterprise applies for qualification as an enterprise of installation and maintenance of gas combustion apparatus, the relevant provisions of Notice on Matters Concerning Qualification Administration of Enterprises of Installation and Maintenance of Gas Combustion Apparatus (Jiancheng [2007] No. 250) shall still be implemented.

(49) The Implementation Opinions shall come into force as of March 1, 2015. The Opinions on the Implementation of Construction Enterprise Qualification Management Regulations issued by the former Ministry of Construction on October 18, 2007 (CCB [2007] No. 241) shall be repealed at the same time.
